Over the past 30 years, our child custody attorneys have assisted numerous clients with child custody, visitation and other aspects of divorce. Our firm also includes a board-certified family law specialist.

Mediation Versus Litigation In Child Custody Disputes

Most counties in North Carolina either mandate or offer mediation services to help parents come to mutually acceptable decisions about child custody matters. If mediation is not successful, however, a District Court judge will have the final say, determining who will have primary physical custody, who will have visitation rights and how much child support should be paid.

Our law firm understands that litigation is expensive and contentious, and it should usually be the last resort. Nevertheless, if going to trial is in your best interests — or your spouse refuses to negotiate — we are skilled trial attorneys who are fully prepared to defend your parental rights before the judge.

Visitation Rights

Both the courts and child psychologists believe that it is best for children to maintain healthy relationships with both parents, not just one. For this reason, the courts will usually grant visitation rights to the noncustodial parent. This visitation can take two different forms: reasonable visitation and structured visitation.

Reasonable Visitation

Instead of having a set schedule, both parents agree to allow visitation times that are reasonable and fair. "Reasonable" is a subjective term, however, and many parents cannot agree on this.

Structured Visitation

A structured visitation agreement provides specific times and days that the non-custodial parent can spend time with his or her children. An example is having visitation privileges every other weekend, one evening during the week and three weeks during the summer.
